What does Arizona law require?

Arizona law says a landlord must provide reasonable air conditioning or cooling where units are installed, and must keep the heating, cooling and ventilation facilities in good and safe working order. You can read the text at A.R.S. 33-1324.

The law covers equipment the rental already has. Whether a unit counts as installed, and what is reasonable, can depend on the lease and the facts, so ask a tenant rights group or an attorney if it is disputed.

Is there a temperature limit in Tucson?

In Tucson, a rental cooled by air conditioning may not exceed 82F in habitable rooms, and an evaporative-cooled unit may not exceed 86F, according to the Arizona Attorney General’s office in a May 27, 2025 release. A 2026 bill, SB 1608, proposed a statewide 82F maximum and 68F minimum. It was a proposal, so don’t treat it as the law.

What should you do first?

Put the request in writing and keep a copy. Describe the problem and the date it started, include photos and room temperatures if you can, and ask for a repair date. Send it the way your lease says and keep proof it was sent.

  1. Send a written request to the landlord or property manager.
  2. Keep a log of dates, messages, calls and temperatures.
  3. Don’t stop paying rent or hire your own contractor until you have checked your rights, since either can backfire.
  4. Contact a tenant rights group or attorney if the problem is ignored.

The Arizona Attorney General has warned landlords about these obligations, which gives you a place to start reading. If heat is a danger to someone in the home, leave for a cooler place.
